Two Doctors in Malaysia Ordered to Pay RM5.1 million for Causing Brain Damage to a Patient

The High Court ruling against Pusat Pakar Tawakal Sdn Bhd and its doctors, ordering them to pay RM5.1 million in damages to the late Datuk Zainudin A Kadir’s representative (Datuk Zainuddin was a former CEO of Projek Lintasan Kota Holdings Sdn Bhd). highlights a tragic case of medical negligence resulting in severe consequences. The court’s decision underscores the importance of upholding medical standards and accountability in the healthcare sector.

The incident, which led to the unfortunate demise of Zainudin, stemmed from complications during nasal surgery in 2016. The surgery, which took place on 26th February, ended abruptly with Zainudin collapsing shortly after. According to hospital guidelines, doctors are required to monitor patients in the recovery room for a minimum of one hour following the reversal of anesthesia before allowing them to leave. However, in this instance, observation was cut short at 25 minutes. The patient, who was still feeling drowsy, suffered brain damage because the surgeon mistakenly placed a tube into the esophagus instead of the trachea.

Judge Datuk Mohd Arief Emran Arifin’s assessment of the case emphasised the compelling evidence presented by the plaintiff, establishing a clear link between the medical team’s actions and the resultant harm suffered by Zainudin.
